Is there a possibility he could also be known as Maximiano Vargas. Mr. Vargas was also shot and killed at this same time and was interred in White Oaks.

MURDER
Last Tuesday Col. Edwin L. Elwood, for some two or three years a well known citizen of White Oaks, got on a “high lonesome” which differed in its consequences from those preceding. So far as our information goes the Col. never had much of an appetite for blood but he had an inordinate thirst for whisky. Tuesday, he succeeded in filling his tank. During the day his intimates were Mexicans and most of his potations were unmeasured having been imbibed from the bottle. His principal compadre during the latter part of the day was a young Mexican, scarcely over 20 years, named Maximiano Vargas, lately employed as roustabout at the Chinese Restaurant. As darkness filled the streets the Col. and his young friend were filling waste places concealed beneath their hides. When the day lengthened to between the hours of 10 and 11 the Col. with a full commissioned drunk and the Mexican with a brevet jag on, started for home.
What occurred afterwards, save that young Mexican was shot to death is yet enshrouded in mystery.
Shortly after the shooting, as is usually the case under such circumstances, a crowd arrived at the scene, the Col. was arrested on suspicion-the crime having been committed near the Col.’s door-and the dead body was housed.
Next day the autopsy revealed that a 45 calibre ball had penetrated the Mexican’s left shoulder and made its exit out of the right arm pit.
Wednesday a coroner’s jury was empaneled and a number of witnesses were examined. The one who knew the least was the suspect, Col. Elwood. There were several women and children witnesses, who gave contradictory testimony which led the jury to determine that the deceased became such at the hands of either the Col. or his wife. Accordingly both take a St. Patrick’s Day ride in a chaise to the Lincoln bastille on Thursday.
The dead boy leaves a mother and two younger brothers to feel the blow which struck from their sides a son and brother.

On Monday, Edward L. Elwood was tried for the murder of one Carillo, at White Oaks on the night of March 15th last. This the leading trial of the term, occupied the entire day. After a strong and vigorous prosecution by Mr. Barber, and an equally strong defence by Col. Jewett and Hon. A. B. Fall, the jury brought in a verdict of not guilty, being out but twelve minutes. Public opinion indorses the verdict, although some one, as yet unwhipped of justice, is responsible
